Speed equal means all speed is equal regardless of what form they may take, so unless you want to change the rules in order to give Ichigo an advantage because you don't want to admit that there's no way he can win otherwise, Hitsugaya rapes.

If speed weren't equal in all forms it would totally defeat the purpose of speed being equal in the first place. Everyone follows this rule to begin with, all you're doing is trying to abuse loopholes because you don't want to admit that Ichigo can't win.
