Those with the power, please do check the edit history. I hate to be nit-picky but this rule was not stated by a viz admin, just a "quasi-admin" and I'd like verification. I can understand about them not being able to be used, but why they got removed from the post doesn't make sense to me.

Seems to me that making a new badge every month will be difficult to do from an admin standpoint (plus, what if you run out of designs?). Even having a set of 12 badges (1 for each month) is somewhat difficult to do. What more, can a person be member of the month more than once? I know that a person may not win MotM twice in a row... So having individual badges could stretch the postbit on the left vertically if a person is popular enough.

It's hard to copy the style of the current "badges" in use, so I thought I'd re-create the others so that there would be a "matching set".




The Kunai and the Shuriken are of my own design.

As you can see, I've used the Konoha Police Force (aka. Uchiha Clan) insignia in these ranks, and I've put a Konoha Leaf for the Member of the Month. I guess technically the Konoha Police Force symbol has a shuriken behind the Uchiha Clan symbol, but it was a little redundant to have 2 shurikens (for super mod/viz admin) and would have made the symbol hard to see (too small). The shuriken is already near impossible to see on the viz admin rank...

All images are inspired by the series, but not lifted directly from copyrighted sources. The text is also inspired by the Naruto logo, but you'll noticed key differences (the gradient goes across the whole word, rather than each letter; the drop shadow isn't a crisp block but rather a soft drop).

I have Photoshop PSD files for each badge presented as well as for all individual pieces that compose the badges (to prove individuality of the design and ownership). This means that anything is subject to change upon request.

If these don't get used for this website, and someone wants to borrow them for their own personal fan-website, send a PM to me.

And I guess if that imagery is unacceptable then I can do a new set.

Nope, symbols that are specific to Naruto are regrettably not allowed. The emoticons have headbands, but if they had visible leaf village symbols on them they'd never have been accepted either. As for the favicon, that had to be approved by Viz headquarters in Japan along with any other Naruto characters and symbols that are present on this site.

Meaning unfortunately those badges wouldn't be allowed because of the Uchiha Symbol. That said, things like Kunai, Shuriken, and Headbands(as long as they don't have any Naruto symbols on them), though they may reference Naruto, they are not things that are specific to Naruto meaning Viz has no legal say in how you use a picture of a kunai or Shuriken or headband. Meaning they would be allowed.

The short of it is, if we could legally allow those badges to remain posted in the forums, then we'd be able to use them as badges too. However, since we can't use them as badges for legal reasons, why would you think we'd be allowed to leave those pics up in the public forum?

Moving on, you can almost always trust the word of a Quasi. We're one step below Viz-Admins for a reason. But if you'd like a Viz-Admin to check my reasoning anyway, Sage Mode appears to be online.

How about either a really dark shade of grey or a really light shade of grey so still standing out but not much not like the mods and quasi's badges who needs to stand out more due to their positions

This is something that always bothered me about Err's badges. Why go with a gray color scheme on a gray forum when you could just go transparent? >_>

Well the only reason why I suggested it is so that it wouldn't stand out as much due to it not being an important symbolization/position, I mean MOTM is cool and all but still they don't need flashy cool looking badges, just simple dull ones will do.

But with that thinking, why would anyone WANT to be the member of the month? Dull thinking = Dull reward = lack of people who'd want it. If you guys make a lame reward, no one will keep their interest. Not saying that it should be flashy, but I AM saying that if dull is the way you guys are thinking you may as well give up now.

If you make it so that people want it, people may actually try to make quality posts in order to get it.

Legally Viz is protected by the Digital Millenium Copyright Act, user submitted content is not subject to legal ramifications. For example, when YouTube started up people put up full length movies and TV episodes and YouTube was not obligated to remove the content. After Google purchased YouTube, Viacom sued and Google decided that as a favor to copyright holders content would be removed. During the law-suit it was discovered that YouTube employees were uploading copyrighted material - which is not protected by the DMCA because those employees represent the company rather than being end-users.

Even so, parody or tribute art is legally protected. If I were to draw Naruto in my own free time, does that mean that I'm breaking a law? Should I be fined? Or perhaps jailed? Clearly, no. Weird Al Yankovic borrows melodies from other musicians very often, and he even sells his parody music. In DeviantArt there are numerous artists that take commission work to draw famous characters in scenes or situations not presented by official channels. Are all of these people breaking the law? No.

I submit to you, that there is no legal risk for leaving the images in the post - as these were not screen captures or scans from copyrighted material.


Now then, if the agreement to use the Naruto characters, logo, or Konoha leaf included a statement which forbade the use of any other Naruto imagery - then I can understand not being able to use them on the site for badges. But this does not apply to users as it is not part of the end user license agreement (I checked). In fact the only forum rule that comes close is this one:

No fanart, fanfiction, fansubs, or scanlations that make use of official characters or storylines owned by us (Viz Media).

No "fanart" that makes use of characters or "storylines" (presumably storylines means people making a comic which copies the events of Naruto - in an effort to explain what happens in the manga).

The badges which I posted do not contain characters, nor does it contain storylines. Merely symbols. I have broken no rules.



The only reason I asked for a Viz admin's confirmation is because as I see it the quasi-admin has misinterpreted the rules. After all, the Viz admin did not make mention of it in the original rule list - it was a user that made the recommendation. And a quasi-admin is the one that said it was "common sense" which implies that there is an over-arching rule in place. It was a different quasi-admin (you) that removed the content of my post, which based on my research is a mis-interpretation of the rules on your part. So, I've asked a viz admin to call judgement and if necessary amend the forum rules to be more clear.

FYI - I am a Namco/Bandai moderator, particularly for the Naruto video game websites that NBGI creates. I'm familiar with rules and requirements for official Naruto endorsed communities. I'm not just arguing to argue, I just want to be clear on how this staff runs things.
