Styles make fights and I think this one could go either way. If we assume that Toshiro's technique with the 100 snowflakes is a 100% kill if it connects. Which it has not demonstrated to date being as Haribel is still alive and quite well, then I would say Toshiro.

I would argue that if it is a 100% kill he would win based solely on the fact toshiro is quick to use bankai and powerful moves, which is not a weakness. Conversely, Kenpachi is quick to let you use strong techniques on him because he is a Sado Masochistic freak of nature and likes to see what his opponents got. Which is a very poor strategy actually, he's lucky to be alive at this point.

Now if Toshiros' move is not 100% kill, and Haribel being alive suggests that you can be freed from it from at least an outside source, though it can just as easily be argued she freed herself and WW's cry was just a rally call. Much like Grimmjow removed himself from Rukia's nearly identical ice attack, tho she is less powerful than Hitsuguya, Haribel is more powerful than Grimmjow, so no clear way to determine if that is the case.

But if it is possible to free yourself on your own power, then I think Kenpachi would win, I just don't think Toshiro could take the physical beat down as well as say Ichigo or even Nnoitera for that matter, he's not built for it like they are.

Seeing as I played both sides of the fence I guess this is a non-answer.

It doesn't matter if it's not 100% kill, Kenpachi still can't break out of it meaning that Hitsugaya gets the win either way.

Harribel is plainly superior to Hitsugaya in every way. The only reason she didn't oinstantly kill Hitsugaya was because plot demanded that she lose.

Whether or not it's possibly to free yourself with your own power(unlikely as it is), I don't see how Kenpachi's shown the necessary feats to do so in the first place.
