I dont know why kishi made obito to be tobi , but one thinkg is for sure

madara was the one who made akatsuki , at the moment when he met kisame
after that madara told obito all what he knew and he become obito sensei to teach him all those jutsus

Madara made akatsuki after he met Nagato and Yahiko, as boys. Unless kisami is Jiraya's age. Then maybe he was an adult before Nagato fought Hanzo.
